Thank you for using the services of WAYS.
WAYS offers a specialized mobile and web tool for connecting job seekers and employers in the hospitality and tourism industries and other services related to talent development, advertising, and promoting events in the hospitality field. WAYS does not provide student services or work opportunities to other users.
Currently, the BETA VERSION of the WAYS web application is available.
The owner and operator of the website www.waysabroad.com and the WAYS mobile and web applications is WAYS d.o.o., software development and education, Ljubljanska ulica 1, 1000 Ljubljana, Slovenia.
By using the WAYS services and registering or logging into the WAYS web or mobile application, you confirm that you have read the terms of use below, agree with them, and fully accept them.
WAYS reserves the right to change and supplement these general terms of use. The modified terms of use apply from the date of publication on the website.

1. GENERAL

The content of the general terms refers to all forms of using WAYS content and services (hereinafter: service).
The service includes:
  • the website www.waysabroad.com;
  • the WAYS mobile application for job seekers;
  • the WAYS web application for employers;
  • free newsletter subscription.
These terms of use (hereinafter: terms of use)describe, define, and regulate the terms of use of the listed services and represent a legally valid and binding agreement between WAYS company and users.
Used terms:
The owner and operator of the services is WAYS d.o.o., software development, and education, Ljubljanska ulica 1, 1000Ljubljana, Slovenia (hereinafter: operator). The operator is also a development actor, a manager of the website and applications, and a controller of personal data.
The website www.waysabroad.com, is intended for unregistered and registered users who browse the content on the website and search for information about WAYS services (hereinafter: visitors, also users).
The beta version of the WAYS web application means that the current version of the application contains most of the main functions but is not yet final. The beta version is released for testing, receiving feedback, upgrading, and fixing any issues. After completing the beta version, the official version of the application will be released. Users of the beta version will be informed about upgrades and any changes.
The WAYS mobile application is intended for use by individuals seeking work in the hospitality and tourism industry (hereinafter: job seekers, also registered users). It is a place where supply and demand for jobs in the hospitality professions meet.
The WAYS web application is intended for use by legal entities offering jobs and publishing job ads (hereinafter: employers, also registered users). Employers are also personal data processors(hereinafter: processors).
The WAYS website application is also intended for use by legal entities advertising. The terms of use of the website are determined by the price list and individual cooperation agreements(hereinafter: advertisers, also users).

2. USE OF SERVICES

No registration is required to use the website and the content published on the WAYS website, and both registered and unregistered users can use it. Unregistered users have limited access to certain content that is intended only for registered users.
WAYS web application for employers
Only registered users - employers can use the beta WAYS web application. Access to the web application is through the website www.ways.com. The use of the beta version of the web application is free. When registering, the employer creates a company profile, which includes basic company information, a contact person, and enters the company's logo and photos of the company or services it offers. Employers must agree to the terms of use and the privacy policy when registering. After successful registration, the employer can access the WAYS web application, which allows, among other things, the creation of ads and communication between the company and job seekers. The job advertisement includes the company name, location address, job interest area, duration of work, payment amount (the job advertisement lists the gross starting hourly or monthly salary), and when the payment will be made. In the beta version of the web application, the employer can publish any number of job ads. If the employer does not complete or interrupts the profile creation, the data is not saved. Similarly, data is not saved if the employer does not complete the ad creation.
Employers do not have access to job seekers' personal data unless a registered job seeker voluntarily applies for a job advertisement. By accepting these terms of use, the employer agrees to protect and handle job seekers' personal data in accordance with applicable personal data protection legislation.
WAYS website application for job seekers
Only registered users - job seekers can use the beta WAYS website application. The use of the beta version of the website application is free. When registering, the job seeker creates their personal profile, where they enter their profile picture, personal information, education information, foreign language knowledge, job search information, and work format, and if desired, enter recommendations from former employers and links to social networks. Job seekers must agree to the terms of use and privacy policy when registering. After successful registration, the job seeker logs into the mobile application, where they have access to personalized job ads, chat rooms, personal calendars, and profiles. If the job seeker does not complete or interrupts the profile creation, the data is not saved.
By voluntarily applying for a job advertisement, the job seeker agrees to have their personal information forwarded to the respective employer, who selects job seekers based on personal data.
Employers only have access to job seekers' personal data in case of a voluntary application for a job advertisement.

3. USER SERVICE OBLIGATIONS

Each user uses all services at their own risk and is solely responsible for the software and hardware they use to access the service provider's services.
A registered user is responsible for all activities performed with their username, so they undertake to properly secure their username and password from unauthorized use.
A registered user of services is solely responsible for the accuracy and credibility of the entered data, as well as its further use and interpretation.
The user undertakes not to use the service provider's service for illegal purposes, in violation of the provisions of the law or ethnic and moral standards.

4. RESPONSIBILITY LIMITATION

The administrator enables access to the website for unregistered users, access and use of the web application for registered jobseekers, and access and use of the web application for registered employers.
The administrator strives to ensure smooth and flawless operation of the website, mobile and web applications. The administrator will do its best to maintain and upgrade the server hardware as necessary. Due to the nature of the service and the internet, the administrator cannot guarantee that the service will be constantly available. The administrator is not responsible for any damages caused by system development or service interruption.
The administrator strives for accuracy and timeliness of content on all parts of the website, mobile and web applications, but does not guarantee or take responsibility for their accuracy or timeliness. The administrator is also not responsible for any damages to legal or physical persons caused by the use of this information. The administrator has the right to change the content of the website, web and mobile applications at any time without obligation to inform users and is not responsible for the consequences of such changes.
The administrator is not responsible for the suitability of the entered content or user activity.
The employer and employee establish a mutual relationship outside the mobile and web application, so the administrator is not involved in this relationship and does not interfere.
The administrator and its partners are not responsible for any indirect, direct or consequential damages caused by the use or inability to use any of the administrator's services.
The administrator is not responsible for damages caused by unauthorized use or misuse of the user's username or password.
The administrator is not responsible for any damages that may occur on the user's hardware, software, or other equipment due to the use of the administrator's services. The user must provide adequate protection of their equipment (antivirus, etc.) before accessing and using the services.
The administrator uses links to other websites as part of its services that are not under the administrator's control. The administrator is not responsible and does not assume responsibility for information and materials or other content available on third-party websites.

5. ACCESS TO SERVICES

The operator will strive to make all content on the website, web application, and mobile application available for use 24 hours a day, every day of the year, except in the case of brief interruptions due to technical reasons. If longer interruptions are necessary, the operator will inform users in a timely manner.
The operator will occasionally perform upgrades or maintenance work, mostly during night time.

6. USER SUPPORT

The operator enables users to receive support via email at support@ways.com during business hours from 9:00 am to 3:00 pm. Registered users can also communicate with the operator through the integrated chat in the web application and mobile application. The operator provides assistance for all content and technical issues. Registered users also have access to a knowledge base in the form of frequently asked questions.

7. MISUSE OR ABUSE OF SERVICES

Any use of the website, mobile or web application that could damage, disable, overload, or harm the website, mobile and web applications, technical equipment, or the company is prohibited.
In case of misuse or abuse of services, the operator reserves the right to immediately limit or disable access to services to registered and unregistered users without prior notice, and may also terminate the contract without notice.
Registered users are responsible for any damage caused to the operator due to misuse.
In case of violation of the terms of use, the operator reserves the right to limit or terminate the use of services by the user.

8. SERVICE TERMINATION

In the beta version of the web application, the employer can terminate their user account and delete their personal profile at any time. Before doing so, they must ensure that they have no outstanding obligations to employees. To terminate a user account, please email support@waysabroad.com. In the message, provide your username (email address) and state that you want to terminate your account.
The registered user agrees that the operator may delete their user account and disable the use of services at any time if the registered user provided incorrect or misleading information.

9. CONFIDENTIALITY OF DATA

The controller and registered user shall treat as confidential all information about the other party provided during the registration process in the mobile or web application. The contractual parties shall not disclose such information and are obliged to take effective measures to prevent any misuse of such information.

10. PRIVACY STATEMENT

The data controller respects your right to privacy and strives to provide the highest level of protection for your personal data. Therefore, in providing our services, we are committed to operating in accordance with the laws and regulations that define the protection of personal data, in particular in accordance with the current Personal Data Protection Act, the Electronic Communications Act, and the EU General Data Protection Regulation (GDPR).
The data controller carefully protects all personal data obtained from users in accordance with applicable personal data protection legislation and uses them exclusively for the purposes for which they were provided.
The user of the data controller's services expressly allows the data controller to collect and process personal data for the purpose of providing services in accordance with the Privacy Policy, which is an integral part of these terms of service.
The Privacy Policy and personal data protection legislation applicable at the time of use of the data controller's services also bind the user of the services.

Processing of personal data by the controller
The controller of personal data is the company WAYS d.o.o. Personal data can only be used by authorized persons of the controller. All personal data that the registered user enters on the website, in the mobile or web application, is transmitted to the controller. The controller handles personal data in accordance with the applicable legislation in the field of personal data protection. We do not collect or use data without the user's consent and we do not provide or make them available to third parties or institutions, except in cases determined by law or with the express permission of the user.
The user voluntarily provides their personal data and thereby authorizes their use. The user has the right to access, correct and delete the data provided, which can be done by sending a request to the email address: support@waysabroad.com or by viewing their user profile within the mobile or web application.
The personal data we use is appropriate and of an appropriate scope for the purposes for which we collect and process it. We do not use sensitive personal data as defined in the EU General Data Protection Regulation.
Within the scope of legal powers, the user's personal data is disclosed to the following data processors:
  • administrator and website, mobile application, and web application administrator,
  • information technology service providers in the context of software development, servicing, and maintenance.
The controller uses appropriate technical and organizational procedures to protect personal data processed to prevent unauthorized access to acquired data or their disclosure, maintain the accuracy of personal data, and ensure their appropriate use.
We do not provide personal data of job seekers to third parties except to registered employers who gain access to the jobseeker's personal data when the job seeker voluntarily applies for a job advertised by a specific employer. Otherwise, job seekers review job ads anonymously. The controller only provides data to the extent necessary for a specific reason for the transmission.
Processing of personal data by a registered employer (processor)
Registered employers have the option to view jobseeker profiles only when registered job seekers apply for a job. At that time, a communication channel is also opened between the job seeker and the employer, through which they can communicate.
The registered employer undertakes to:
  • process personal data of registered job seekers who apply for a job only for the purpose of seeking personnel,
  • handle personal data carefully and ensure their protection in accordance with the rules of the EU General Data     Protection Regulation (GDPR) and the applicable law governing the protection of personal data,
  • provide adequate organizational and technical security measures for secure acquisition, processing, and transmission of personal data,
  • in case of a personal data breach (e.g. unauthorized access, intrusion into an information system, etc.), notify     the data controller immediately or as soon as possible and take all possible measures to stop the breach and remedy any harmful consequences.

12. PRICING OF SERVICES AND PAYMENT CONDITIONS

The beta version of the WAYS mobile application is free for job seekers.

13. FINAL PROVISIONS

These general terms and conditions are published on the website www.waysabroad.com
The operator reserves the right to make any changes, partial or complete, to any part of the general terms and conditions. The changes apply from the moment they are published on the website.
For disputes arising from the use of WAYS services and these general terms and conditions, the law of the Republic of Slovenia applies exclusively. Any disputes arising from this agreement will be resolved by mutual agreement of the involved parties. Otherwise, the court in Ljubljana has jurisdiction to settle disputes.
By using the WAYS website or mobile and web applications, the user agrees to the terms of use.
